Terms and Conditions
ARTICLE 1 – PRINCIPLE OF THE AWARDS
At Le Mondial du Bâtiment exhibition at Paris Expo Porte de Versailles, which includes BATIMAT, IDEOBAIN and INTERCLIMA (September 30th to October 3rd, 2024), hereinafter referred to as the “Exhibitions”, RX France is organising the Innovation Awards in order to promote the most innovative products and solutions at the Exhibitions.
ARTICLES 2 – CONDITIONS OF ENTRY
The Innovation Awards are only open to entries from exhibitors and co-participants registered for one of the 3 exhibitions (BATIMAT, INTERCLIMA or IDEOBAIN) in 2022.
ARTICLES 3 – ADMISSIBILITY OF INNOVATIONS
All products or solutions entered in the Innovation Awards must have been launched on the market within less than 2 or 3 years (i.e., after 01/10/2022).
ARTICLE 4 – ENTRY PROCEDURE
In order for an Innovation Awards entry to be formally registered, Awards entrants must complete the following 2 steps before 12 midnight on 10 MAY 2024:
- Fill in the online form, available on the platform (ensure you complete it carefully in French and in English),
- Send the mandatory additional items: HD photos of the innovation, HD logo of the company, 60-second video pitch presenting the innovation (in French or English).
THE INNOVATION AWARDS ENTRY WILL BE VALIDATED ONLY IF EXHIBITORS COMPLETED ENTRY BEFORE 12 MIDNIGHT ON 10 MAY 2024. NO ENTRIES RECEIVED AFTER THIS CLOSING DATE WILL BE ACCEPTED, AND EXHIBITORS SHALL NOT BE ELIGIBLE FOR A REFUND OF THE REGISTRATION FEES.
Exhibitors may enter as many products and services as they wish to the Innovation Awards. They must complete a full entry for every innovation they wish to present.
ARTICLE 5 – TRUTHFUL INFORMATION
Awards entrants undertake to provide the Selection panel with information that is truthful and accurate and avoid any omission or imprecision that could lead to an incorrect judgment.
If an entrant is proved to have infringed this rule, the panel reserves the right to withdraw a prize that has already been awarded or withdraw the product or solution from the competition; the Innovation Awards entrant shall not be eligible for a refund of the amount committed.
Entrants may only present products, solutions or systems that they have produced or designed, or for which they are agents or dealers. In the event of a corporate alliance, the company entering the innovation will be cited in all communications.
Awards entrants represent to the organiser that the products, solutions or systems entered do not infringe any third-party rights, or that they have obtained from the intellectual property right holders the necessary rights and/or authorisations in order to enter the relevant products, solutions or systems in the Innovation Awards.
The organiser shall not be liable in any way in this area.
Entrants accept full liability for their products or solutions with respect to third parties; the organiser cannot in any way be held liable. If any claim is made against the organiser by a third party due to an entrant’s product/solution, the entrant shall indemnify the organiser for all costs reasonably incurred by the organiser for its defence and any sentences handed down.
ARTICLE 6 – PRESELECTION
Awards entries shall be filtered using an initial preselection process, which will rule out any entries that fail to meet the necessary criteria (product on the market prior to the date mentioned in Article 3, product outside the scope of the Innovation Awards, incomplete entry, poorly written entry, etc.). Amounts committed shall not be refunded for any products examined but ruled out at preselection.
ARTICLE 7 – JUDGING AND DISTINCTIONS
All entries that pass the preselection phase will be studied by a competent Panel of expert judges (representatives of the media, trade bodies, etc.). The different Panels shall select Nominees and Winners (the Innovation Awards are not split into different categories).
Judges on the various panels shall assess the products/solutions on the basis of the information provided in the entry. If necessary, they may contact Awards entrants (via the organiser) for further information; entrants undertake to provide this information.
The judges’ decisions regarding the selection of shortlisted products/solutions and the prizes awarded shall be independent and final.
ARTICLE 8 – SELECTION CRITERIA
In awarding the prizes, the following criteria will be notably taken into account:
- the innovative nature of the product/solution,
- improvements/benefits for end users,
- technical characteristics of the product,
- new functions offered,
- associated services (after-sales service, maintenance, servicing, etc.),
- user-friendliness/comfort of the product,
- product aesthetics,
- compliances with standards and certifications,
- markets and applications covered by the product,
- quality of the competition entry (texts, visuals, video pitch, etc.).
ARTICLE 9 – RESULTS
The Nominees will be announced in JUNE 2024, a few days after the selection panels have met.
The Award Winners will be unveiled at the end of JUNE 25, 2024. The awards ceremony will take place on the first evening day of the Exhibitions.
ARTICLE 10 – TERMS OF USE FOR INFORMATION
Special marketing efforts will be undertaken before and during the Exhibitions, using the names and descriptions of the products/services entered in the competition (unless otherwise requested by entrants, who must make this known in writing at the time of entry).
RX France reserves the right to slightly modify the text and/or translation, with the aim of making the presentation of the innovation more explicit and understandable for the Judging Panel and Exhibition visitors.
ARTICLE 11 – ACCEPTANCE OF THE RULES
Entering the Innovation Awards entails total acceptance of all clauses herein, without any entitlement to challenge the terms or the results of the Awards.
ARTICLE 12 – INTELLECTUAL PROPERTY
Awards entrants represent that they have not transferred or licensed out the intellectual property rights to their products, solutions or systems.
They authorise the organiser to publish their full name, the full contact details or their company and their description of the products, solutions or system as part of the Innovation Awards and/or Exhibitions marketing and communication campaigns; such use shall not give rise to any right or remuneration of any nature.
Awards entrants authorise the organiser to use the images, videos and photos of their product/solution/system free of charge, and to reproduce and represent the products/solutions/systems free of charge throughout the territory and throughout the validity of the relevant rights, in the Innovation Awards and/or Exhibitions communications tools (including, but not limited to Internet, exhibition catalogue, invitations, visitors map, promotional video, Ceremony photos, media, TV shows, social media…).
Awards entrants represent to the organiser that they have obtained from the intellectual property right holders all necessary rights and/or authorisations for the aforementioned uses concerning the products, solutions or systems they enter.
ARTICLE 13 – MODIFICATION OR CANCELLATION OF THE INNOVATION AWARDS
If the Exhibitions are cancelled or postponed or the registration levels are low, the 2024 Innovation Awards shall as of right be cancelled and the organiser shall not be held liable.
Awards entrants shall be liable for all risks relating to the potential for the Innovation Awards to be cancelled, and in particular shall bear all their own costs incurred in preparing for the Awards.
ARTICLE 14 – PRIVACY AND DATA PROTECTION
The personal data provided by entrants to the organiser is necessary for the fulfilment, administration, management and monitoring of their Innovation Awards entry. The people mentioned in the entry and any subsequent exchanges may be contacted by the organiser, the exhibition hall manager and their subcontractors in order to facilitate the company’s participation in the Innovation Awards and the provision of any related products and services. Entrants may have access to Personal Data through entry in the Innovation Awards. They undertake to comply with all “Data Protection Laws” as a data controller; however, this shall not entail any transfer of rights, in particular intellectual property rights, to the databases of the organiser or other rights holder. “Data Protection Laws” are hereby understood to refer to all laws, rules, regulations, directives, decrees, orders or other legal obligations applicable to the protection or processing of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”) and all legislation, rules or other regulations of the European Union (the “Union”), a Union Member State, Switzerland or the UK, implementing the same, ensuing therefrom or relating thereto.
Awards entrants must implement and maintain the appropriate technical and organisational methods to ensure that their processing of personal data meets the applicable GDPR requirements (especially all measures required under Article 32 thereof), guarantee the protection of the rights of people whose data is held and provide a level of protection at least comparable to the protection required under the “Data Protection Laws”.
ARTICLE 15 – AMENDMENT TO THESE RULES / SEVERABILITY
The organiser reserves the right to rule on any cases not covered by these Rules and add new provisions whenever it deems necessary for the smooth running of the Innovation Awards.
Should any one of the provisions herein be considered null and void, whether in part or in full, for any reason whatsoever, it shall not affect the other provisions hereof. In such a case, the Parties shall undertake to negotiate in good faith to agree on a provision that, as far as possible, has an equivalent effect.
ARTICLE 16 – DISPUTES - LIMITATION
In the event of a dispute, regardless of the object, entrants undertake to send a claim to the Organiser by registered letter, with acknowledgement of receipt, before initiating any other proceeding. Any action initiated within 15 days following receipt of said registered letter shall be inadmissible.
In accordance with Article 2254 of the French Civil Code, the parties agree to set a limit of one year (1 year) for rights and legal action concerning the liability of the organiser due to its own actions, those of an employee or a third party, regardless of the cause thereof. This period shall begin from the expiry of the 15-day timeframe stipulated above.
RELATIONS BETWEEN THE INNOVATION AWARDS ENTRANTS AND THE ORGANISER SHALL BE FULLY AND EXCLUSIVELY GOVERNED BY FRENCH LAW. IN THE EVENT OF A DISPUTE, THE COURT OF COMMERCE OF NANTERRE SHALL HAVE SOLE JURISDICTION.
